Public-Private Partnership in Healthcare

Photo 2025 12 09 14 10 28

Ukraine’s healthcare sector requires large-scale modernization and recovery following the destruction caused by the full-scale war. The Government of Ukraine, together with international partners, is forming a portfolio of priority investment and grant projects in the healthcare sector. This portfolio has been included in the State Single Project Pipeline and the DREAM public investment management system.

The Government is interested in modernizing the material and technical base of existing state-owned and municipal healthcare facilities in order to ensure more efficient delivery of medical services through the use of modern models of care (increasing the productivity of existing medical infrastructure).

When implementing public-private partnerships in the healthcare sector, it is essential to maintain a balance between the social and commercial components of projects, taking into account the need to ensure an appropriate standard of medical care.

Party to a public-private partnership in the healthcare sector may include:
  • Municipal healthcare facilities (the majority of healthcare facilities that could participate in public-private partnerships are municipally owned, operate in the legal form of municipal enterprises, and have concluded contracts for the provision of medical services to the population under the State Medical Guarantee Programme);
  • Certain sanatoria and other state-owned healthcare facilities;
  • Medical universities, including their dormitories and university hospitals (the Ministry of Health is currently taking measures to establish a network of university hospitals in various regions of Ukraine in order to ensure a high level of practical training for future medical professionals - students and interns - enhance the skills of practising doctors, nurses and other healthcare professionals, maintain the professional competencies of academic staff of clinical departments of medical universities, and introduce modern diagnostic and treatment technologies).

A public-private partnership (PPP) involves long-term cooperation between the State and private entities, based on contractual relationships with a distribution of risks, resources, and responsibilities. In the healthcare sector, PPPs allow not only the mobilisation of additional financial resources but also ensure effective management, the introduction of innovations, and the improvement of the quality and accessibility of services.

On 31 October 2025, the new Law of Ukraine “On Public-Private Partnership” came into force, replacing the previous legislation. The new law focuses on simplifying investment attraction for post-war reconstruction by expanding the sectors covered, introducing new financing mechanisms, and aligning with European standards for infrastructure projects. From now on, the list of sectors where PPPs can be applied is no longer exhaustive. The new law formalises the possibility of implementing PPP projects in the healthcare sector, including the construction of facilities and the provision of related services.

Forms of implementing public-private partnership:

Under this Law and other legislative acts of Ukraine, the following agreements may be concluded within the framework of a PPP:

1.   Concession agreement

2.   PPP agreement
